- 04In Japan, foreigners, regardless of their nationality, residence status, or whether they have permanent residency, can acquire and register ownership of real estate (land and buildings) in exactly the same way as Japanese citizens, and are free to buy, sell, and inherit such properties. In principle, there are no legal restrictions on purchases, however, if you reside overseas, you may need to request assistance with the procedures, and for some properties, you may be required to report to the Minister of Finance within 20 days of acquisition.
- 05Farmland can be purchased by individuals if they obtain permission based on the Farmland Act (mainly the Agricultural Commission), but in general it is limited to farmers. When non-farmers purchase, a plan for "new farming" is required, and harmony with the community and efficient use are required. However, if you convert farmland into housing land, you can purchase it by applying for permission.
- 06When purchasing real estate, additional “miscellaneous costs” of around 10% of the property price are typically required. The main components include brokerage fees, registration and license tax, fire insurance premiums, stamp duty, real estate acquisition tax, property tax and city planning taxes, and various escrow service fees. Many of these are paid in cash at the time of contract signing and handover.
